Terms & Conditions

These terms and conditions[1] are applicable to all services of Visa Support & Business Solutions GmbH (hereinafter referred to as VISA SUPPORT). Other terms and conditions will not be part of the contract, even if they are not expressly contradictory. They also apply to non-traders and retailers. Conflicting or supplementary contracts as well as additional contracts are only valid if they are confirmed in writing by Visa Support GmbH.

 

Contract

 

By sending an order to VISA SUPPORT via the Internet (Online Management System, any other OMS[2]), e-mail, telephone, fax or other means of communication, the customer receives an offer to conclude a contract with VISA SUPPORT. OMS on the website www.visa-support.de is non-binding. The overview of visa types does not represent a legally binding offer, but a non-binding compilation of different types of visa, depending on the country of destination.

 

Confirmation of receipt of the customer's order via OMS takes place together with the acceptance of the order and the sending of the invoice immediately after the paid transaction by an automated e-mail.

 

The contract customers [3]are informed about the receipt of the order in the customer area.

 

The two order confirmation types do not represent an acceptance of your offer, but are only intended to inform you that your order from us has been received. A contract is only concluded if the ordered service is not contradicted by the foreign authority on the next working day after 14.00 of German time after the comprehensive examination in the substantive and legal point of view. In the case of a refusal, we undertake to notify you immediately. If VISA SUPPORT can not accept the offer of the customer, the customer will be informed of the unavailability instead of the acceptance of the order.

 

The text of the contract is not saved separately by Visa Support GmbH. The data of order will be made available to the customer in the e-mail confirmation. The general terms and conditions of the current version can be viewed and downloaded on visa-support.de.

 

In individual cases, Visa Support GmbH reserves the right to decline orders that do not meet the requirements of Visa Support GmbH or whose customers are known to be unworthy of credit.

 

Visa Support GmbH only accepts orders and delivery addresses within the EU. Any payments, which may have already been made, are transferred back to the credit card account minus accrued transaction fee

 

Maturity

 

  1. The purchase price is due at the time of the conclusion of the contract with immediate effect. The amount due will be charged in advance. The amount debited and the credit card charges are made with the completion of the order. All prices are end customer prices which are included in the statutory sales tax.

 

The payment is made by credit card.

  1. The contract customers will receive invoices due and payable within 14 calendar days of the invoice date. In case of delay of the customer, Visa Support is entitled to charge delay interest of 3.5% above the respective bank rate of the Deutsche Bundesbank. The charge of further or higher damage caused by delay is not excluded hereby.

 

Payment

 

Visa Support receives remuneration for its services according to its valid price list or the agreed special conditions. The remuneration shall also be payable if, without the fault of Visa Support, the order placed can not be executed, or can not be executed completely or on time. Checks and bills of exchange are always accepted by Visa Support upon performance. A payment obligation remains even if a visa or passport application has not been accepted, since the contract is a service contract, without a debt to success.

 

Sending

 

The sending of the documents by Visa Support to the customer is carried out at the expense of the customer by express delivery or on the other delivery from the customer when placing the order expressly stated. Correct and timely delivery is always reserved. Information on delivery times is approximate. Agreed delivery times begin on the next working day from the date of our confirmation of order and are only valid upon timely clarification of all details of the order. Delivery periods are extended as far as the buyer is in default with his obligations towards us. In the case of force majeure or its equivalent unforeseen events, which are beyond our control, agreed deadlines shall be extended appropriately; this also applies if additional information about the performance of the order has to be provided or has to be obtained

 

Liability for risks

 

The customer is responsible for the timely receipt of documents necessary for the execution of the order at Visa Support. The date of the return of the documents to the customer by Visa Support is the date of a postmark. The sending risk, including the risk of timely receipt of the sending by the customer, shall be borne by the customer.

 

Data protection

 

Visa Support uses the personal data of the buyer and the second buyer under the purpose of this contractual relationship in compliance with the European General Data Protection Regulation (EU GDPR). In this case, the named data such as name, address, telephone number, e-mail address, bank details and business address are only processed, used and collected to the extent necessary for the specific execution of this contract. The data may in individual cases be passed on to third parties, if this serves to execution of the contract. Each contract requires the written consent to be transferred to a third country in accordance with Art. 44 and the following of EU GDPR.

Liabilities

 

Statements of claim for Visa Support - including those of a non-contractual nature - are excluded in the case of slightly negligent breach of duty by Visa Support, its officers and other performing agents of Visa Support, unless the breach concerns a duty that is essential to the purpose of the contract, however, the liability of Visa Support is limited to the foreseeable, typically occurring damage. This damage is limited to a maximum of €250 for the replacement of basic, written or supportive documents, which have been given to Visa Support by the customer and for the loss of which Visa Support is responsible. Visa Support is only responsible for indirect and unforeseeable damages at the time of the conclusion of the contract if gross negligence or intent has been caused by Visa Support. We undertake no responsibility for the correctness of the content of orders placed with us. We assume that the client has carefully checked the order forms given to us for their accuracy and order time.

 

Corrections/Complaints/Cancellation

 

Requests for change must be made in writing. We accept no responsibility for statements made verbally or by telephone.  Requests for changes will only be considered as they appear possible within the time frame. The additional costs will be charged to the customer, at which the advance information to the customer is made. Cancellation of an order for Russian invitations is only allowed during the day the order is placed. From this moment the full price will be charged. In addition, a placed visa demand order can be withdrawn at any time with a written explanation. The costs incurred up to the time of cancellation, the service fee in full and the costs for the return of the application forms will be borne by the customer.

 

Any payments, which has already been made, will be refunded minus applicable transaction fees or sent back to the credit card account.

 

Choice of law and place of jurisdiction

 

German law applies. The use of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded of jurisdiction for any disputes arising from the business relationship between the customer and Visa Support GmbH as far as the customer, merchant, legal entity of public law or legal special assets, or has no general place of jurisdiction in Germany or relocated abroad after conclusion of the contract or his domicile is not known at the time the complaint is filed, but the seat of Visa Support GmbH. For lawsuits against Visa Support GmbH, Bonn is the exclusive place of jurisdiction. Mandatory legal provisions on exclusive jurisdictions remain unaffected by this provision.

 

Concluding provisions

 

Should individual clauses of these general terms and conditions be completely or partially invalid, this does not affect the validity of the remaining clauses or the remaining part of such clauses. Any change to these terms and conditions must be in writing in order to be effective. However, we reserve the right to change the terms and conditions at any time. The conflicting conditions of the customer are hereby expressly contradicted. You will not be authoritatively informed even if Visa Support does not object to them at the time the contract is concluded.
